01 Agreement to these Terms

These Terms of Service (“Terms”) are a legal agreement between you and VISIONTAP LIMITED (“VISIONTAP,” “we,” “us,” or “our”). They govern your access to and use of the CherryWorlds mobile application, AI features, game servers, worlds, characters, interactive stories, and related services (together, the “Service”).

By creating an account, signing in, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use CherryWorlds.

02 Eligibility and accounts

You must be at least 18 years old, legally able to enter this agreement, and permitted to use the Service where you live. CherryWorlds is not intended for minors.

You may sign in using an email verification code or a supported third-party sign-in provider. You are responsible for your device, account access, and activity under your account. Provide accurate information, keep access secure, and tell us promptly if you believe your account has been compromised. You may not sell, transfer, share, or create an account for someone else.

03 The Service

CherryWorlds lets you enter fictional worlds, create or customize a protagonist, meet AI characters, exchange messages, make choices, play interactive events, send invitations, build relationships, and carry selected memories and world changes into later play.

Features, worlds, characters, language support, availability, and technical requirements can vary by platform, device, region, account, app version, and release stage.

04 AI and fictional content

Character messages, suggested replies, events, summaries, memories, and world changes can be created or adapted using artificial intelligence. Characters, relationships, locations, events, and story outcomes are fictional unless we clearly say otherwise. They do not represent a real person communicating with you.

Generated content can be inaccurate, unexpected, inconsistent, repetitive, or unsuitable for some users. The Service does not provide medical, mental-health, legal, financial, professional, or emergency advice. Do not rely on generated content as fact or as a substitute for qualified advice. In an emergency, contact the appropriate local service.

Your choices may affect later dialogue and world state, but we do not guarantee any particular reply, relationship outcome, memory, event, or story path.

05 Your content

“User Content” means messages, prompts, custom actions, protagonist details, choices, feedback, and other material you submit through the Service. You keep any rights you have in your User Content.

You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, modify, and display User Content only as reasonably needed to operate, secure, support, and improve the Service, generate requested content, comply with law, and enforce these Terms. You confirm that you have the rights needed to submit your User Content and permit this processing.

06 Acceptable use

You must not use the Service to:

• break the law, violate platform rules, or infringe another person’s rights;
• create, request, promote, or distribute sexual content involving minors, grooming, child exploitation, or other illegal sexual material;
• threaten, harass, exploit, impersonate, defraud, or cause harm to another person;
• create hateful content, non-consensual intimate content, malicious code, or instructions intended to facilitate serious wrongdoing;
• upload malware, disrupt the Service, probe security, or access accounts or systems without authorization;
• scrape, reverse engineer, automate, resell, or overload the Service except where applicable law expressly permits; or
• bypass moderation, rate limits, access controls, entitlements, or other safeguards.

We may restrict inputs or outputs, remove content, limit features, or take action against accounts when reasonably needed to enforce these rules, protect people, or comply with law.

07 Safety and reporting

If generated content appears illegal, unsafe, or offensive, stop the interaction and report it to [email protected]. Include the world, character, approximate time, and a description of the problem. Do not include passwords or verification codes.

We may review relevant account, conversation, event, and diagnostic records to investigate a report and improve safeguards. Reporting does not guarantee a specific result, but we will review credible safety concerns.

08 Service availability and changes

We may add, change, test, limit, suspend, or discontinue worlds, characters, models, features, or the Service. Content may be revised or removed, and maintenance, provider outages, network conditions, or technical failures may interrupt access. We do not promise that a specific feature or item of generated content will remain available permanently.

Updates may be required to continue using the Service. You are responsible for a compatible device, software, and internet connection.

09 Future paid features

CherryWorlds does not currently offer paid in-app items or subscriptions. If paid features are introduced, the price, billing period, renewal terms, benefits, and cancellation method will be shown before purchase. Purchases made through Apple or Google will also be governed by the applicable store’s payment and refund rules. We will update these Terms when paid features launch.

10 Intellectual property

The Service, including its software, design, brand, characters, worlds, artwork, text, systems, and other non-user content, is owned by VISIONTAP or its licensors and is protected by intellectual-property laws. These Terms do not transfer ownership to you.

While you comply with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for personal entertainment.

11 Third-party services

The Service relies on third parties for authentication, hosting, networking, analytics, diagnostics, email, and AI generation. Your use of a third-party sign-in provider or app store can also be subject to that provider’s terms. We are not responsible for third-party services outside our control.

12 Suspension, termination, and deletion

You may stop using the Service at any time. You may request account deletion as described in our Privacy Policy. Deleting the app or signing out does not delete your account.

We may suspend, limit, or terminate access if we reasonably believe you violated these Terms, created risk or harm, attempted fraud or abuse, or used the Service in a way that could harm users, VISIONTAP, providers, platforms, or the Service. Where appropriate, we may provide notice or an opportunity to appeal by contacting support.

13 Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, story continuity, and uninterrupted or error-free operation. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

14 Limitation of liability

To the maximum extent permitted by law, VISIONTAP and its directors, employees, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, profits, or service availability arising from the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid to CherryWorlds during the 12 months before the event giving rise to the claim or USD 100. This limitation does not apply where liability cannot lawfully be limited.

15 Applicable law and consumer rights

These Terms apply alongside any mandatory consumer rights available where you live. Nothing in these Terms limits a right that cannot lawfully be waived. Any dispute must be brought in a court with jurisdiction under applicable law, unless you and VISIONTAP agree to another lawful process.

If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, financing, or sale of the Service.

16 Changes and contact

We may update these Terms as the Service changes. If a change is material, we will take reasonable steps to notify you, such as updating the effective date, posting a notice, or providing an in-app message. Your continued use after updated Terms take effect means you accept them.
